ISSUES FOR BRIEFING

1. Whether the disputed site is the birth place of Bhagwan

Ram?

The disputed site is the birth place of Lord Ram. Place of

birth is a juristic person and is a deity. It is personified as the

spirit of divine worshipped as birth place of Lord Rama as a

child.

Spirit of divine ever remains present every where at all

times for any one to invoke at any shape or form in accordance

with his own aspirations and it can be shapeless and formless

also.

2. Whether the disputed building was a mosque? When

was it built? By whom?

The disputed building was constructed by Babar, the year

is not certain but it was built against the tenets of Islam. Thus, it

cannot have the character of a mosque.

3. Whether the mosque was built after demolishing a

Hindu temple?

The disputed structure was constructed on the site of old

structure after demolition of the same. The Archaeological

Survey of India has proved that the structure was a massive

Hindu religious structure.

4. Whether the idols were placed in the building on the

night of December 22/23rd, 1949?

The idols were placed in the middle dome of the disputed

structure in the intervening night of 22/23.12.1949.

5. Whether any of the claims for title is time barred?

O.O.S. No. 4 of 1989, the Sunni Central Board of Waqfs

U.P ., Lucknow and others Vs. Gopal Singh Visharad and others

and O.O.S. No.3 of 1989, Nirmohi Akhara and Another Vs. Sri

Jamuna Prasad Singh and others are barred by time.

6. What will be the status of the disputed site e.g. inner

and outer courtyard?

It is established that the property in suit is the site of

Janm Bhumi of Ram Chandra Ji and Hindus in general had the

right to worship Charan, Sita Rasoi, other idols and other object

of worship existed upon the property in suit. It is also

established that Hindus have been worshipping the place in

dispute as Janm Sthan i.e. a birth place as deity and visiting it as

a sacred place of pilgrimage as of right since time immemorial.

After the construction of the disputed structure it is proved the

deities were installed inside the disputed structure on

22/23.12.1949. It is also proved that the outer courtyard was in

exclusive possession of Hindus and they were worshipping

throughout and in the inner courtyard (in the disputed

structure) they were also worshipping. It is also established that

the disputed structure cannot be treated as a mosque as it

came into existence against the tenets of Islam.

Hon'ble Sudhir Agarwal, J.

1. The area covered under the central dome of the disputed structure is

the birthplace of Lord Rama as per faith and belief of Hindus.

Disputed structure was always treated, considered and believed to be

a mosque and practised by Mohammedans for worship accordingly.

However, it has not been proved that it was built during the reign of Babar

in 1528.

In the absence of any otherwise pleadings and material it is difficult

to hold as to when and by whom the disputed structure was constructed but

this much is clear that the same was constructed before the visit of Joseph

Tieffenthaler in Oudh area between 1766 to 1771.

4. The building in dispute was constructed after demolition of Non-

Islamic religious structure, i.e., a Hindu temple.

5. The idols were kept under the central dome of the disputed structure

in the night of 22nd/23rd December 1949.

Other Original Suits no. 3 of 1989 and 4 of 1989 are barred by limitation.

Hon'ble Sibghat Ullah Khan ,J.

1. The disputed structure was constructed as mosque by or under orders of Babar.

2. It is not proved by direct evidence that premises in dispute including constructed portion

belonged to Babar or the person who constructed the mosque or under whose orders it was

constructed.

3. No temple was demolished for constructing the mosque.

4. Mosque was constructed over the ruins of temples which were lying in utter ruins since a

very long time before the construction of mosque and some material thereof was used in

construction of the mosque.

5. That for a very long time till the construction of the mosque it was treated/believed by

Hindus that some where in a very large area of which premises in dispute is a very small part birth

place of Lord Ram was situated, however, the belief did not relate to any specified small area

within that bigger area specifically the premises in dispute.

6. That after some time of construction of the mosque Hindus started identifying the premises

in dispute as exact birth place of Lord Ram or a place wherein exact birth place was situated.

7. That much before 1855 Ram Chabutra and Seeta Rasoi had come into existence and

Hindus were worshipping in the same. It was very very unique and absolutely unprecedented

situation that in side the boundary wall and compound of the mosque Hindu religious places were

there which were actually being worshipped along with offerings of Namaz by Muslims in the

mosque.

8. That in view of the above gist of the finding at serial no.7 both the parties Muslims as well

as Hindus are held to be in joint possession of the entire premises in dispute.

9. That even though for the sake of convenience both the parties i.e. Muslims and Hindus

were using and occupying different portions of the premises in dispute still it did not amount to

formal partition and both continued to be in joint possession of the entire premises in dispute.

10. That both the parties have failed to prove commencement of their title hence by virtue of

Section 110 Evidence Act both are held to be joint title holders on the basis of joint possession.

11. That for some decades before 1949 Hindus started treating/believing the place beneath the

Central dome of mosque (where at present make sift temple stands) to be exact birth place of Lord

Ram.

12. That idol was placed for the first time beneath the Central dome of the mosque in the early

hours of 23.12.1949.

13. That in view of the above both the parties are declared to be joint title holders in possession

of the entire premises in dispute and a preliminary decree to that effect is passed with the condition

that at the time of actual partition by meets and bounds at the stage of preparation of final decree

the portion beneath the Central dome where at present make sift temple stands will be allotted to

the share of the Hindus.

Order:-

Accordingly, all the three sets of parties, i.e. Muslims, Hindus and Nirmohi Akhara are declared joint title holders of the property/ premises in dispute as described by letters A B C D E F in the map Plan-I prepared by Sri Shiv Shanker Lal, Pleader/ Commissioner appointed by Court in Suit No.1 to the extent of one third share each for using and managing the same for worshipping.

A preliminary decree to this effect is passed. However, it is further declared that the portion below the central dome where at present the idol is kept in makeshift temple will be allotted to Hindus in final decree.

It is further directed that Nirmohi Akhara will be allotted share including that part which is shown by the words Ram Chabutra and Sita Rasoi in the said map.

It is further clarified that even though all the three parties are declared to have one third share each, however if while allotting exact portions some minor adjustment in the share is to be made then the same will be made and the adversely affected party may be compensated by allotting some portion of the adjoining land which has been acquired by the Central Government.

The parties are at liberty to file their suggestions for actual partition by metes and bounds within three months.

List immediately after filing of any suggestion/ application for preparation of final decree after obtaining necessary instructions from Hon'ble the Chief Justice.

Status quo as prevailing till date pursuant to Supreme Court judgment of Ismail Farooqui (1994(6) Sec 360) in all its minutest details shall be maintained for a period of three months unless this order is modified or vacated earlier.

The online sites for Chase retail banking and credit card transactions are down due to technical problems.

Millions of users/clients have been unable to access their accounts and go on with their daily activities such pay their bills online and make transactions.

The company is aware of the problem but has thus far been unable to fix the issue.

Meanwhile Chase is asking its clients to use good old ATM’s for their bill payments and other banking services as they try to resolve their online banking problems.Chase has 16.5 million customers who bank online and many are growing increasingly frustrated with the lack of information and the span of this outage.

It is not uncommon for big websites to have issues but it is odd for such an important site to suffer an outage lasting for so long without a real explanation.

As to when the site will be up and running again, no one knows at the moment.

JPMorgan Chase & Co. confirmed the outage this morning with a message posted on the website. It appears the problem began overnight, and the company is working to fix it, said spokesman Tom Kelly.

ATMs at Chase, the nation’s second-largest bank, were not affected. The bank’s telephone banking service was also operating normally.

The bank urges customers to conduct their transactions at a branch or by phone, at 1-800-935-9935. A recording at that phone number tells callers to expect a long wait to speak with a banker

The American

Erykah Badu

Soul and R&B singer Erykah Badu is still dealing with the fallout from her controversial music video "Window Seat," in which the singer disrobed at the site where President John F. Kennedy was assassinated. Badu has paid a $500 fine and will serve six months' probation for stripping off her clothes to film the music video in her hometown of Dallas. The 39-year-old music star had been charged with disorderly conduct in April over her nude video shoot in Dealey Plaza. Badu agreed with prosecutors to serve probation that will end February 11.
In "Window Seat," Badu sheds all her clothes throughout the course of the song as she walks and runs through the plaza. At the end, a gunshot rings out and she collapses to the ground naked, as blue blood spills out to form the word "groupthink."

Rooney Mara 'The Girl With The Dragon Tattoo

Ending one of the most drawn out and closely watched casting searches for an actress in years, Sony Pictures Entertainment and director David Fincher have chosen Rooney Mara to play Lisbeth Salander in The Girl With The Dragon Tattoo, the film that begins shooting this fall in Sweden, with Daniel Craig starring. The film will be released December 21, 2011. Rooney was considered Fincher's first choice in the process: the director had just helmed her in The Social Network. Closing a deal will amount to a formality, because Mara essentially agreed to terms when she and other young actresses signed on to tests that Fincher and producer Scott Rudin have conducted over the past several weeks. Her deal includes an option for two sequels that will cover The Girl Who Played With Fire and The Girl Who Kicked The Hornet's Nest, the second and third books in the Millennium Trilogy by the late author Stieg Larsson. The books continue the same murder conspiracy storyline.

Deadline revealed that Craig was signed a deal with two options weeks ago to play Mikael Blomkvist, the investigative journalist and part owner of the magazine Millennium, and Deadline also broke the story that Robin Wright was in talks to play Erika Berger, his occasional bed partner and the publisher of Millennium. Stellan Skarsgard was also reportedly in talks to play Martin Vanger, who joins the magazine's board.

The search for Salander has been the role that really captured the public fancy. Slight of frame and short, Salander is a brilliant but troubled computer hacker who helps Blomkvist unravel a decades-long murder mystery. The storyline is as dark as the subject matter that Fincher tackled in Seven, and subsequent books establish Salander as far more than Blomkvist's sidekick (and occasional lover). While established actresses have been named as being in contention for the role -- Natalie Portman (who tried to buy the books early on), Ellen Page (who filmed her own test), Carey Mulligan and most recently Scarlett Johansson -- Fincher has focused his testing process on discovering an actress who fits Salander physically and in age proximity, which is early 20s. Mara was among a group of young actresses that included Alice In Wonderland star Mia Wasikowska, Sucker Punch's Emily Browning (even though neither actress signed test deals), Fish Tank's Katie Jarvis. Mara tested along with Sophie Lowe, Sarah Snook and French actress Lea Seydoux.

Mara is a strong match: she is the right age and looks like Salander. She also had the advantage of working with Fincher and Rudin on The Social Network. The sister of Brokeback Mountain's Kate Mara and the great granddaughter of New York Giants football team founder Wellington Mara and Pittsburgh Steelers founder Art Rooney, Mara was most recently seen in the remake of A Nightmare on Elm Street. Aarti Sequeira took home the title of "The Next Food Network Star" on Sunday (Aug. 15) finale, beating out Tom Pizzica and Herb Mesa,after 10 grueling weeks.

The final challenge was taping a three minute pilot (directed by Food Network personality Rachael Ray), which would then be judged by a focus group. Sequeira's nerves were almost her undoing for a bit there, but after a little advice from Ray, she pulled it together and delivered a charming and upbeat pilot. All three finalists received positive reactions from the focus group, although one person mentioned Sequeira seemed to be rushing.

The star of her own food blog brought that passion for cooking in front of the cameras, overcoming more experienced chefs and self doubt. Her culinary point of view is infusing Indian flavors and techniques into everyday American cooking.


She won't get to rest on her laurels for long. In a week's time, her show "Aarti Paarti" will debut on the Food Network.

Pre-Installation Steps:

1. Create oracle users and groups.
groupadd oinstall
groupadd dba
groupadd oper

useradd -g oinstall -G dba,oper oracle

2. Set Kernel Parameters

Edit /etc/sysctl.conf and add following lines.

3. Creating oracle directories

4. Setting Oracle Enviroment
Edit the /home/oracle/.bash_profile file and add following lines:

Installation:

Download the Oracle 11g release 1 (11.1.0.6.0) software from Oracle website.
Extract the files using following command:
unzip linux_11gR1_database.zip


Now the system is prepared for Oracle software installation. To start the installation process go to database directory and execute the following commands:
cd database
./runInstaller


Post-Instalation:

Auto Startup and Shutdown of Database and Listener

Login as root and modify /etc/oratab file and change last character to Y for apropriate database.

As root user create new file "oracle" (init script for startup and shutdown the database) in /etc/init.d/ directory with following content:

This isn't the best design for one-handed use, as the D-pad isn't available in portrait mode. Because I use the D-pad frequently, I find myself using the Droid with the keypad open most of the time.

There's a sort of "chin" to the right of the keyboard, which you have to reach around to type or use the D-pad. This isn't any kind of hassle to me, and to be honest I hadn't even noticed it until someone pointed it out.

When the Droid's slider is closed, you can use an on-screen keyboard. This allows yo to enter short amounts of text with the device in portrait mode, though this keyboard is so cramped you are going to want to pull out the physical one to enter more than a few words.

The on-screen keyboard is also available in landscape mode, where it is much more usable. I prefer hardware keyboards, but the Droid's virtual one is nearly as usable, as long as it's in landscape mode.

Yamaha launches three new bikes

Japanese two-wheeler maker Yamaha launched three bikes in India, priced between Rs 47,000 and Rs 52,000 a unit.
The three motorcycles - SZ, SZ-X and YBR125 - were unveiled by Bollywood actor and Yamaha brand ambassador John Abraham.
"The launches of these three bikes are in line with Yamaha's true commitment to provide world class product to its customers. We are confident that these bikes will capture the imagination of the whole generation of bikers who are looking for something extra," India Yamaha Motors CEO and Managing Director Yukimine Tsuji said.
